Kan. accountant sentenced for embezzling $500K from employer

SEDGWICK COUNTY – A man convicted of embezzling more than $500,000 from the Wichita pawnshop where he worked was sentenced to 32 months in prison Tuesday.

According to a media release from the Sedgwick County Attorney, Phillip H. Jelinek, 35 of Wichita, entered a guilty plea to felony theft on June 25 in Sedgwick County District Court.

The charge against Jelinek alleged that he embezzled $587,450.83 from A-OK Enterprises LLC, where he worked as an accountant.

The thefts occurred over a two-year period and involved money from internet sales.

The prison sentence was imposed by Judge David Kaufman, who said in court that the impact of the theft was “catastrophic” to the business.

Jelinek and his attorney asked Kaufman to consider probation because Jelinek was seeking treatment for a gambling addiction and had sold his house to help pay restitution. Judge Kaufman denied the request.

Bruce Harris, the owner of A-OK Enterprises LLC, said in court that the thefts from his business forced the company into bankruptcy and caused employee layoffs and closure of some locations.

The case was investigated by the Investigations Division of the Office of the District Attorney.

Keller shuts down White Sox in Royals’ 6-3 win

KANSAS CITY, Mo. (AP) — Brad Keller had another effective outing to keep up his impressive rookie season.

Keller pitched seven strong innings to win for the fourth time in six starts, leading the Kansas City Royals to a 6-3 win over the Chicago White Sox on Tuesday night.

“He kind of struggled with his mechanics a little bit early, but he’s a kid who doesn’t give in,” Royals manager Ned Yost said. “He comes right at you with good stuff. … He got pitches to get outs when he needed to.”

Keller (8-6) gave up one run and four hits and two walks while striking out six. He is 4-1 with a 1.62 ERA in his last six starts, lowering his ERA to 3.04 — leading all AL rookies.

Yost isn’t quite ready to talk about Keller in the Rookie Of The Year discussion, but it’s not too far from his mind.

“I haven’t paid attention to who his competition will be,” he said. “I’m very proud and pleased with the year that he’s put together. … He’s only going to get better.”

Keller says it’s an honor to be in the discussion of top rookies, but it’s not his focus.

“I don’t really look at that,” Keller said. “I just try to go out and help the team win. It’s just cool to be in the talks, but that doesn’t matter.”

Whit Merrifield had two hits, two RBIs, and scored two runs for the Royals. He also stole two bases to increase his American League lead to 33 steals, including a league-best 12 of third base.

The aggressiveness on the basepaths, especially since the All-Star break, has been key in the Royals starting to play better at home. They have 47 steals in 48 games since the break.

“We have to force the issue at times,” Merrifield said, “be aggressive and good things happen.”

Wily Peralta picked up his 10th save in 10 chances, despite walking two in 1/3 of an inning.

The Royals have won a season-high seven straight at home — and 10 of 11. After starting 11-35 at home before the All-Star break, the Royals are 16-10 since the break. They need to win three of their final nine games to avoid tying the franchise’s worst home record (1998).

Dylan Covey (5-13) allowed six runs — five earned — and six hits in 4 1/3 innings for the White Sox. He walked three and struck out four. He is now 0-6 with a 9.00 ERA in his last six starts. Over his last 11 outings, he’s 1-9 with an 8.59 ERA.

Covey has struggled against the Royals, falling to 0-7 with a 6.37 ERA in nine career starts.

The White Sox scored a run in the third when Avasail Garcia beat out an infield single, scoring Yolmer Sanchez from third. Garcia rolled it sharply to short, but Adalberto Mondesi appeared to take too long to release the throw to first.

Mondesi made up for his gaffe with an RBI single as part of a three-run third for Kansas City. Merrifield blooped a single to short right field, scoring Brian Goodwin. Mondesi followed with a bunt single that scored Rosell Herrera. A bad throw by catcher Welington Castillo sent Merrifield to third. He scored on Alex Gordon’s sacrifice fly to the wall in right.

The Royals added another run in the fourth. Ryan O’Hearn led off with a triple down the right-field line and scored on Jorge Bonifacio’s ground-rule double to make it 4-1.

Hunter Dozier had a two-run single in the sixth to give the Royals a five-run lead.

The White Sox pulled within three in the ninth against Royals relievers, with Tim Anderson driving in Ryan LaMarre with a single and Yoan Moncada scoring Jose Rondon on a bases-loaded walk.

“We had some opportunities early, didn’t cash them in,” Chicago manager Rick Renteria said. “And then, we gave them a little scare here in the ninth.”

JONES RETURNS

Prior to Tuesday’s game, the White Sox returned RHP Nate Jones from his rehab assignment with Class A Winston-Salem, and reinstated him from the 60-day disabled list. He was placed on the disabled list June 13 with a pronator muscle strain in his right arm. He’s 2-2 and a 2.55 ERA in 27 relief appearances. Jones pitched a scoreless seventh inning against the Royals.

TRAINER’S ROOM

White Sox: OF Leury Garcia remains on the disabled list with a grade-2 left hamstring. “Doing better,” Renteria said. “(He’s getting) a little more activity. He’s still feeling some soreness, some tightness when he’s doing certain things.”

Royals: OF Brett Phillips, who has been out since suffering a right shoulder contusion last Wednesday in Cleveland, continues to improve, according to Yost. Phillips took 30 more swings off the tee Tuesday. “I still don’t have a definite date (for his return),” Yost said before the game. “But he’s getting closer.”

UP NEXT

White Sox LHP Carlos Rodon (6-5, 3.11 ERA) will face Royals LHP Eric Skoglund (1-5, 6.45). Rodon has lost his two starts in September after the Sox won all five of his August starts (he was 3-0 in those starts). Skoglund missed more than three months of the season (86 games) with a strained left UCL. He has pitched two scoreless innings out of the bullpen since his return. He made five rehab starts, going 0-1 with a 3.54 ERA with three different minor league affiliates.

ST. LOUIS (AP) — Cardinals rookie Tyler O’Neill hit a three-run homer during a six-run eighth inning, Marcell Ozuna drove in three and Miles Mikolas pitched seven solid innings to lift the St. Louis Cardinals over the Pittsburgh Pirates 11-5. Mikolas gave up a run, five hits and a walk while striking out seven. He dropped his ERA to 2.99, and he got his first victory in five starts against the Pirates this season. Mikolas struck out five straight in one stretch, and the Cardinals improved to 21-8 in his starts.

MANHATTAN, Kan. (AP) — Kansas State coach Bill Snyder has decided to move forward with a clear-cut starter at quarterback, after watching Skylar Thompson and Alex Delton both struggle the first two weeks of the season. So, it will be Thompson getting nearly all the snaps when the Wildcats face Texas-San Antonio in their non-conference finale on Saturday.

AMES, Iowa (AP) — For all the progress Iowa State has made under coach Matt Campbell, the offensive line has long been a sore spot. The Cyclones showed in their opener that their rebuilt line has yet to find itself. Iowa State gained just 188 yards in a 13-3 loss to Iowa. No. 5 Oklahoma is up next for the Cyclones.

WICHITA, Kan. (AP) — Wichita city officials have approved spending up to $81 million to build a new ballpark for a Triple-A baseball franchise. The council on Tuesday approved a plan that will also pay $2.2 million to the Wichita Wingnuts to break the independent baseball team’s lease at Lawrence-Dumont Stadium, which will be torn down. Mayor Jeff Longwell announced last week that the Triple A team will move from New Orleans to Wichita. The team is an affiliate of the Miami Marlins.

FORT WORTH, Texas (AP) — Ty Summers has come to enjoy chasing quarterbacks and making tackles since he started playing for No. 15 TCU. Summers has made an impressive transition to defense in his five years at TCU after being an all-district dual-threat quarterback in high school. He has now gone from primarily being a linebacker to starting the first two games of his senior season at defensive end. He is the active career tackles leader for the Frogs, who next play fourth-ranked Ohio State.

WACO, Texas (AP) — Baylor has dismissed sophomore point guard Alexis Morris from the team for violating team rules. Coach Kim Mulkey said only that the move was effective immediately. Morris started all six postseason games last March for the Big 12 champion Lady Bears.

National Headlines

BALTIMORE (AP) — Oakland Athletics left-hander Sean Manaea will have season-ending surgery on his left shoulder next week. Manaea has been on the disabled list since Aug. 26 after going 12-9 with one no-hitter, a 3.59 ERA and 108 strikeouts in 160 2/3 innings this year. The A’s are three games behind the AL West-leading Houston Astros and three behind the New York Yankees for the first wild-card berth.

UNDATED (AP) — Hurricane Florence has already caused the cancellation of three Top-25 games before touching down on the East Coast. East Carolina told Virginia Tech officials that the Pirates won’t travel to Blacksburg to face the 13th-ranked Hokies. North Carolina State’s game against No. 14 West Virginia was wiped out, as was No. 18 UCF’s game at North Carolina.

UNDATED (AP) — The Carolina Panthers will be without three-time Pro Bowl tight end Greg Olsen and second-team All-Pro Bowl right tackle Daryl Williams for the foreseeable future after they were injured in Sunday’s 16-8 win over Dallas. The team announced Tuesday that Olsen re-fractured the same right foot that kept him out of nine games last season. Williams suffered an undisclosed knee injury and will need surgery.

FLOWERY BRANCH, Ga. (AP) — The Atlanta Falcons have placed linebacker Deion Jones on injured reserve because of a foot injury suffered in Thursday’s loss at Philadelphia. Head coach Dan Quinn says Jones will require surgery, but is expected to return this season. He’s the Falcons’ second Pro Bowl defensive player to land on injured reserve, joining safety Keanu Neal.

RENTON, Wash. (AP) — The Seattle Seahawks are likely to be without wide receiver Doug Baldwin for at least next week’s game at Chicago and possibly longer due to an MCL injury to his right knee. Coach Pete Carroll indicated it would be difficult for Baldwin to make it back to face the Bears and that it could be a couple of weeks. Baldwin was injured in the first quarter of Sunday’s 27-24 loss to Denver.

UPDATE: Kansas GOP state lawmakers divided over Kobach’s candidacy

TOPEKA, Kan. (AP) — GOP state lawmakers are divided over whether they support fellow Republican Kris Kobach’s candidacy to become Kansas’ next governor, according to a newspaper’s survey.

Johnson County Bar Association Gubernatorial Debate -photo courtesy Kobach for Governor campaign

Twenty-eight percent of GOP lawmakers it surveyed would not say if they support Kobach’s candidacy and close to 10 percent did not respond to repeated inquiries. Four moderate Republicans from Johnson County have already said they will not vote for Kobach.

“I’m not going to take a position on that race. I just don’t feel like it’s any benefit to me to do that,” said House Majority Whip Kent Thompson, a Republican from Iola, without elaborating.

Among Democrats, 94 percent of those in the Legislature said they will support candidate Laura Kelly.

“She will be a great Governor and the alternative is too horrible to even contemplate,” Rep. Jerry Stogsdill, a Prairie Village Democrat, said in an email.

Kobach defeated Gov. Jeff Colyer by 343 votes in the August primary, confirming a deep divide between moderates and conservatives in the state GOP. Since Kobach’s victory, some conservatives have criticized moderates for not supporting the party’s nominee in his race against Kelly and independent Greg Orman.

In August, House Majority Leader Don Hineman, a moderate Republican from Dighton, said in an email to more than two dozen centrists that voting for Orman or Kelly “could well be a career-ending move for anyone who chose to do so.” He did not respond to The Star’s questions about whether he will support Kobach.

Others in the party are strong Kobach supporters.

“Secretary Kobach is the best candidate for governor this State has had in my lifetime,” Rep. Francis Awerkamp, a St. Marys Republican, said in an email.

Kobach has long espoused conservative views on immigration, taxes and social issues and he has indicated during the campaign that he will not work to attract moderate voters in the general election.

He said after the first gubernatorial debate in Overland Park that the lack of apparent support is part of the candidates’ strategic plans when they consider their district’s wishes.

“This is typical in any major election where you have people at different levels up and down the ballot,” Kobach said.

Sen. Barbara Bollier, of Mission Hills, a GOP moderate, said earlier this summer that she would vote for Kelly.

“I don’t understand why not, why they won’t,” Bollier said about moderates not coming out against Kobach. “It’s hard for me to understand. It’s about being electable, they believe, and for me it’s about doing the right thing for the state.”

Pascual Rueda Guzman, 22, Hays, was sentenced in Ellis County District Court to 32 months in prison.

According to the Hays Police Department, Guzman and Dean Joseph Manning were arrested Dec. 9 after they forced their way into a man’s hotel room at gun point in the 3400 block of Vine Street.

They held the victim down and, according to police, the man was shot in the face with a CO2 powered handgun.

Police believe the men were looking for a gun and money that was allegedly stolen from them.

According to the plea deal, Guzman was sentenced to 32 months in prison for aggravated battery and 18 months for intimidation of a witness. The two sentences will run concurrently for a total of two years, eight months in prison.

Manning was also sentenced to 32 months in prison for his role in the incident in February.

Kansas man hospitalized after motorcycle accident has died

BROWN COUNTY — One person died from injuries in an accident just before 8:30a.m. Tuesday in Brown County.

The Kansas Highway Patrol reported a 2007 Harley Davidson motorcycle driven by Shawn Simpson, 40, Hiawatha, was westbound on 290th Street five miles north of Hiawatha.

The driver failed to make the curve at Kill Deer Road. The motorcycle entered the west ditch, rolled and the driver was ejected.

Simpson was transported to KU Medical Center and died Tuesday afternoon.

He was not wearing a helmet, according to the KHP.

Candidate charged with election fraud can remain on Kan. ballot

TOPEKA, Kan. (AP) — A Kansas panel has ruled that a suburban Kansas City man who is charged with election fraud can remain on the November ballot.

The state objections board issued its ruling Monday in the case against Adam Thomas, of Olathe. The finding that the Republican candidate for the 26th District House seat can remain on the ballot has nothing to do with his pending court case.

Thomas was arrested last Thursday and charged with election perjury. Democratic state Rep. Vic Miller, of Topeka, had called for an investigation into Thomas in June after presenting evidence that he didn’t live in the district where he was running.

Thomas’ attorney, Michael Kuckelman, maintains that Thomas will be acquitted in the court case.

The new stadium will cost $75 million and must be completed by March 15, 2020. The city’s agreement includes building a $6 million pedestrian bridge across the Arkansas River.

The move is not final and City Manager Robert Layton said changes could still be made in the agreement.
